OSHA Fines Grocer H-E-B $18K in Warehouse Worker's Death

After an investigation into the death of worker Teresa Domingue, OSHA has fined Texas-based grocery store H-E-B $17,878 for two violations related to the accident.
In October 2025, the Bexar County Medical Examiner's Office said that Dominguez, 27, died of blunt trauma to the left lower extremity while working in a San Antonio H-E-B warehouse, and deemed it a workplace accident, according to Yahoo News.
OSHA cited the grocer with a “serious” violation for failing to properly reevaluate 30 employees for forklift training in a timely manner. The OSHA report states, "an employee was operating a Crown Forklift without having received reevaluation training on the safe operation of the forklift within three years."
H-E-B also faces fines for failing to repair hazardous walking areas and not guarding those areas with hand or guardrails at numerous locations.
When the initial reports came out, the nature of the incident wasn't clear. As the San Antonio Express-News reports, police first stated Dominguez was found unconscious in a warehouse freezer, with the injury possibly related to a forklift. But H-E-B later stated that she was actually exhibiting "signs of distress" and sought help after the forklift came to a stop.
The warehouse has been the site of two workplace deaths over the last few months. In April, Austin Flores, 27, died after suffering a pulmonary thromboembolism from a blunt force injury, according to the Bexar County Medical Examiner's Office and reported by Chron. OSHA is still investigating Flores’ death.
“First and foremost, our thoughts remain with Teresa’s family, friends and our partners following this tragic loss,” H-E-B said in an emailed statement to Supermarket News. “We cooperated fully with OSHA throughout its investigation and partnered with them to address any issues. We take workplace safety seriously and continuously evaluate and improve our practices, training and procedures, with the goal of providing a safe working environment for all our partners.”
